These terms apply to your use of wisemanholidays.com and to any booking you make through it. Please read them carefully — by using the Site or making a booking you agree to be bound by them.
1. Definitions and interpretation
1.1 In these terms:
(a) "Booking" means a confirmed reservation of a Property made through the Site;
(b) "Cancellation Policy" means our cancellation policy at /cancellation-policy, as updated from time to time;
(c) "Guest" means the person making a Booking and the people staying at the Property under that Booking;
(d) "Host" means the owner or manager of a Property listed on the Site;
(e) "Privacy Policy" means our privacy policy at /privacy, as updated from time to time;
(f) "Property" means a holiday-let listed on the Site;
(g) "Site" means the website at wisemanholidays.com and any of its subdomains;
(h) "we", "us", "our" means Wiseman Holidays Ltd.
1.2 Headings are for convenience only and do not affect the interpretation of these terms.
1.3 References to clauses are to clauses of these terms unless stated otherwise.
2. About us
2.1 The Site is operated by Wiseman Holidays Ltd, a company registered in England and Wales with company number 16865199 and registered office at 1 Hanway Place, London, England, W1T 1HA.

3. These terms
3.1 These terms apply to your use of the Site and to any Booking you make through it. By using the Site, creating an account, or making a Booking, you confirm that you accept these terms and agree to be bound by them.
3.2 You must be at least 18 years old to create an account or make a Booking. If you book on behalf of others, you confirm that you have authority to agree to these terms on their behalf and that you are responsible for ensuring they comply with the terms relevant to the Booking.
4. Your account
4.1 To make a Booking you need to create an account. When you create your account you must provide accurate information and keep that information up to date.
4.2 You are responsible for keeping your password confidential and for any activity carried out under your account. If you believe your account has been compromised, you must notify us as soon as reasonably possible at info@wiseman-holidays.co.uk.
4.3 You may close your account at any time by contacting us. We may also close your account in accordance with clause 14.
5. Property listings
5.1 Properties on the Site are listed by Hosts. Hosts provide the information about each Property, including descriptions, photographs, prices, availability, and house rules. We take reasonable care in presenting that information, but we do not independently inspect every Property and we do not guarantee that every detail in a listing is exact.
5.2 Photographs and descriptions are intended to give a fair and representative impression of a Property but may not capture every feature. If anything in a listing is material to your decision to book, please contact us before booking and we will do our best to confirm with the Host.
5.3 House rules set by the Host (for example, no smoking, no pets, maximum number of guests) form part of the Booking. By making a Booking you agree to comply with the house rules for the relevant Property.
6. Making a Booking
6.1 To make a Booking, you select a Property, choose your dates, enter the details requested, and complete payment. Your Booking is not confirmed until you receive a Booking confirmation from us and the Booking status on your trips page shows as "confirmed".
6.2 A binding contract for the Booking is formed between you and us when we send you the Booking confirmation.
6.3 The price of a Booking is shown on the Site before you complete payment and is in pounds sterling (GBP). The price includes any cleaning fees, service fees, and taxes shown at checkout.
6.4 You are responsible for everyone in your party. If anyone in your party breaches these terms or the house rules, we and the Host may treat that breach as your breach.
7. Payment
7.1 Payments are processed by Stripe Payments UK Ltd ("Stripe"). We do not see or store your full card details; Stripe handles those details and returns to us only a payment confirmation and a reference used to process refunds.
7.2 If a payment fails, we may cancel the Booking.
7.3 Refunds are processed through Stripe and are issued to the original payment method. Refund timing typically takes 5–10 business days after we issue the refund to appear in your account, depending on your bank or card issuer.
8. Cancellation and refunds
8.1 You can cancel a confirmed Booking at any time before check-in from your trips page. The refund you receive depends on the Cancellation Policy that applies to the Property and how far ahead of check-in you cancel.
8.2 The Cancellation Policy at /cancellation-policy sets out the refund windows in detail. Please read that policy carefully before you book.
8.3 If we cancel a Booking — for example, because the Property is no longer available — we will refund you in full. We are not otherwise liable to compensate you for the cancellation, except as required by law (see clause 13).
9. Stay conduct and house rules
9.1 You and your party must follow any reasonable instructions given by the Host before and during your stay.
9.2 You are responsible for any damage caused to the Property, its contents, or its surroundings by you or anyone in your party during your stay. The Host may charge you the reasonable cost of repair or replacement.
9.3 You and your party must not:
(a) use the Property for any illegal purpose;
(b) hold a party or large gathering at the Property unless the Host has expressly agreed in advance;
(c) cause unreasonable disturbance to neighbours;
(d) exceed the maximum number of guests stated in the listing;
(e) bring pets to the Property unless the listing permits pets.
9.4 If you or anyone in your party seriously breaches this clause 9, the Host may require you to leave the Property and you will not be entitled to a refund.
10. Site content and intellectual property
10.1 The Site, including its text, images, layout, code, and trade marks, is owned by us or our licensors and is protected by intellectual property laws. Property photographs and descriptions are owned by us or licensed to us by the Host.
10.2 We grant you a limited, non-exclusive, non-transferable licence to access and use the Site for the purpose of browsing Properties, making and managing Bookings, and communicating with Hosts. You may not copy, reproduce, distribute, scrape, or resell any part of the Site or its content without our prior written consent.
11. User content
11.1 When you send messages through the Site (for example, to a Host about a Booking), the contents of those messages are stored so that the conversation can be retrieved by you and the recipient.
11.2 You are responsible for the content of any message you send. You must not send messages that are unlawful, threatening, abusive, harassing, defamatory, discriminatory, obscene, or that infringe anyone's rights.
11.3 We may review messages and may remove content or suspend an account if we reasonably believe these terms have been breached.
12. Acceptable use
12.1 You must not:
(a) interfere with the operation of the Site or attempt to gain unauthorised access to any part of it;
(b) upload malware or any code intended to disrupt the Site;
(c) make Bookings you do not intend to honour, or use the Booking system to test, probe, or stress the Site;
(d) impersonate any person or misrepresent your identity;
(e) collect personal data of other users without their consent.
13. Our liability
13.1 Nothing in these terms limits or excludes our liability for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation;
(c) any other liability that cannot be limited or excluded under English law.
13.2 Subject to clause 13.1, we are not liable to you for:
(a) any loss that is not a reasonably foreseeable consequence of our breach;
(b) any loss of business, loss of profit, or loss of opportunity;
(c) the acts or omissions of any Host, including the condition of a Property or the Host's conduct during your stay, except to the extent caused by our own negligence;
(d) any circumstances outside our reasonable control, including extreme weather, public emergencies, transport disruption, strikes, or government action.
13.3 Subject to clause 13.1, our total liability to you for any one Booking, whether in contract, tort (including negligence), or otherwise, is limited to the amount you paid us for that Booking.
13.4 Nothing in these terms affects your statutory rights as a consumer.
14. Termination
14.1 We may suspend or close your account if you seriously or repeatedly breach these terms. Where reasonable, we will give you notice before doing so.
14.2 You may close your account at any time by contacting us at info@wiseman-holidays.co.uk. Closing your account does not cancel any Booking; to cancel a Booking, see the Cancellation Policy.
15. Privacy
15.1 We process personal data in accordance with our Privacy Policy at /privacy.
16. Changes to these terms
16.1 We may update these terms from time to time. The "Last updated" date at the top of this page shows when they were last changed.
16.2 Bookings confirmed before a change takes effect are governed by the terms in force at the time of the Booking. Bookings made after the change are governed by the updated terms.
17. General
17.1 These terms, and any contract for a Booking made through the Site, are governed by the law of England and Wales.
17.2 You and we agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute arising out of or in connection with these terms, except that if you are a consumer resident in another part of the United Kingdom, you may also bring proceedings in the courts of the part of the United Kingdom where you live.
17.3 Nothing in these terms confers any benefit on, or any right to enforce these terms upon, any person who is not a party to them. The Contracts (Rights of Third Parties) Act 1999 does not apply to these terms.
17.4 If any provision of these terms is found by a court to be unenforceable, the remaining provisions will continue in full force.
